Associate Counsel – COOPERATIVE OF AMERICAN PHYSICIANS – Los Angeles, CA

Summary
Assists the General Counsel in providing legal advice to all departments. Oversees the MedGuard/EP Benefits program.
Essential Duties and Responsibilities:
Advise CAP, MPT, and CAPA-RPG on Legal Matters

  • MPT and Related Coverages: Evaluate coverages provided to CAP members and participants; Manage complaints and/or potential legal actions involving coverage; assist Associate General Counsel in evaluating and resolving MPT coverage issues, as requested
  • Provide legal assistance on company’s Document Retention and Disposal committee
  • Prepare individualized correspondence to physician members who are terminated with open claims or who are denied MPT coverage; Coordinate with Finance to obtain remittals of delinquent accounts
  • Oversee the MedGuard/EP Benefit program by resolving benefits and billing questions, preparing correspondence to members denied benefits (and discussing coverage when needed), monitoring claims trends, facilitating buy-up issues with the Agency and carrier, and managing the selection and retention of panel counsel.
  • Draft, negotiate, and review company contracts with company vendors and business partners
  • Review, create, and revise letters, coverage documents, and other agreements with MPT members
  • Monitor, analyze, and report on legislative and regulatory developments and assist in compliance with state and federal statutes, in particular HIPAA/HITECH and Medicare;
  • Monitor and manage all requlatory filings for CAPAssurance, a Risk Purchasing Group
  • Assist company departments with physician inquiries about certain coverages, benefits or other membership issues
  • Write articles for CAPsules
  • Assist the General Counsel with legal research and analysis of company legal and business issues, as requested
  • Assist with company training and employee awareness of the company’s cybersecurity and privacy program while, like all employees, remaining responsible and vigilant when opening emails on CAP’s computer equipment and while accessing the company system remotely.
  • Perform other responsibilities as assigned

Education and/or Experience:

  • J.D. degree
  • Five years of experience as practicing attorney
  • Medical professional liability and defense coverage experience preferred
  • Knowledge of Health Insurance Portability and
  • Accountability Act (HIPAA)
  • Experience in legislative and regulatory monitoring and analysis

Pay: $100,000.00 – $130,000.00 per year
